Check-in and Check-out

CHECK IN/CHECK OUT: Arrival time is no earlier than 3:00 p.m.The lease begins at 3:00 p.m. Monday thru Saturday and 5:00 p.m. on Sundays. Check out is at 11:00 a.m. per dates stated in the Booking Confirmation. Check out time is assumed to occur the day after your last reserved night. If you are going to be checking in after dark, please contact Homeowner. Guest will use the digital code listed on the Booking Confirmation to gain access to The Cabin. Check out time occurs the day after your last reserved night no later than 11:00 A.M. – NO LATE CHECKOUTS.
CANCELLATIONS: Homeowner has a strict no cancellation policy. Deposits and Rental Fees are nonrefundable. As Guest, We have been strongly recommended by Homeowner to purchase travel insurance to protect our vacation investment. Homeowner offers no refunds or reservation exchanges.
The Cabin is provided in "as is" condition. The homeowner shall use its best efforts to ensure the operation of all amenities in The Cabin. The homeowner shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible.
RENTAL PARTY: Guests must be 18 years of age or older to reserve The Cabin.
MAXIMUM OCCUPANCY: The maximum number of guests is limited to seven (7) persons. An additional charge per person per night for guests in addition to two (2) will be assessed. If Guest requests additional guests over the seven persons, Homeowner must agree prior to booking the reservation.
RENTAL RULES: Guest agrees to abide by the Rental Rules consolidated herein at all times while at The Cabin and shall cause all members of the rental party and anyone else Guest permits at The Cabin to abide by the Rental Rules at all times while at The Cabin.
ACCESS: Guest shall allow Homeowner access to The Cabin for purposes of repair, inspection, and housecleaning. The homeowner shall exercise this right of access in a reasonable manner.

Housekeeping, Pets, Smoking and Parties

HOUSEKEEPING:
  • Daily housekeeping services are not included in the rental rate. 
  • Linens and bath towels are furnished for use inside The Cabin. Bath towels or linens are not to be removed from The Cabin and are only to be used for their intended use of bathing or bed linens. Makeup remover is supplied for the Guest's use to remove makeup. The cleaning products provided stain the towels and wash cloths. Please use the scrub pads and/or the brown & tan towels found in the closet to clean tub/shower, sinks, floors, etc. Any stained towels or linens will be replaced using the Guest's Security Deposit. If replacement cost exceeds the Security Deposit, the Guest will be responsible for the additional cost of replacement. 
  • For Guests staying longer than seven (7) days, all linens and bath towels will be washed by Homeowner between the hours of 11:00 a.m. and 3:00 p.m. on the seventh (7th) day. 
  • Guest will be charged a housekeeping fee should the departure cleaning require additional housekeeping services or times outside of 11:00 a.m. and 3:00 p.m. and will be deducted from the Security Deposit. 
PETS: Pets are allowed under the following conditions: With prior notification from Guest to Homeowner, pets are allowed at The Cabin if they remain contained in a crate when Guest is away from The Cabin. Pets are to remain on a leash until the front gate has been closed. Guest acknowledges that The Cabin is in the country where wildlife roam and equine reside. The Homeowner is not liable in any way of any kind of injury, including but not limited to death, of a Guest's pet.
SMOKING: Smoking is not allowed inside The Cabin. Smoking is only allowed outside. If cigarette butts are found on the grounds a $50 deduction from the Security Deposit will be made without notice.
PARTIES: Parties are NOT allowed without prior written approval and an additional fee is paid in an amount agreed upon by Homeowner and Guest. Small weddings or Family gatherings are permitted at a small additional fee agreed upon by Homeowner and Guest prior to check-in.

MAINTENANCE, REPAIRS, AND RULES

AS IS: As stated in the Short Term Rental Agreement, The Cabin is provided in "as is" condition. This statement includes, but not limited to, Wi-Fi speed, DirecTV service level and lack of content.
SEPTIC SYSTEM: The Cabin is on a septic system. DO NOT FLUSH ANYTHING OTHER THAN TOILET PAPER. No feminine products should be flushed at any time. If anything other than toilet paper is flushed causing the septic system to be clogged, you could be charged a service fee to remedy the problem. WHEN FLUSHING THE TOILET, HOLD THE LEVER DOWN FOR FIVE SECONDS.
OUTAGES: We occasionally experience outages that are beyond our control. No refunds or compensation will be given for any outages including, but not limited to water, electric, Wi-Fi Internet, DirecTV, and monitored security cameras.
FIRE EXTINGUISHER: The Cabin has one fire extinguisher located under the kitchen sink and another one upstairs underneath the desk. The fire extinguishers are inspected and fully charged prior to Guest check-in. Guest agrees to use the fire extinguishers only for true emergencies and to report to Homeowner their use of the extinguisher(s).
LEFT ITEMS: Valuable items left behind by Guest will be held for the Guest and every reasonable effort will be made to contact the Guest for the return of such item(s). If items are not claimed for longer than 6 months they become the property of the Homeowner.
TV: DirecTV provided. PAY PREVIEW IS NOT ALLOWED. Reformatting the TV in anyway is not allowed. If Homeowner should have to reformat the TV settings a $50 deduction from Guest's Security Deposit will be made without notice to Guest.
WIFI: WI-FI is provided as a convenience only and is not integral to the Agreement. Data is limited; therefore, downloading any large amounts of data such as videos, movies, YouTube, etc. requiring large amounts of data is prohibited. Excessive data usage (more than one (1) GB, will be deducted from the security deposit. Guest can purchase additional GBs at $10/per GB. The password to the WI-FI is 9261Cabin.
FIRE: Guest agrees to only burn the provided manufactured fire logs or ethanol fuel in the Living Room Fireplace. Guest can use one manufactured log or one-quart ethanol fuel per night. If more than one manufactured log or one quart of ethanol fuel is used per night, a $15 charge per manufactured log or quart of ethanol fuel will be deducted from Guest's Security Deposit without notice to Guest. Guest agrees to close fireplace glass doors when exiting The Cabin. Guest agrees that the fireplace wire screens remain pulled closed always. Homeowner will clean the Fireplace.
SHOES: Guest agrees to remove shoes when entering The Cabin or to use the rugs stored underneath the beds located in the living room to avoid soiling the living room area rug. Homeowner's time and expense for cleaning stains from the area rugs will be deducted from the Security Deposit without notice.
BATH TOWELS: Bath towels or linens are not to be removed from The Cabin and are only to be used for their intended use of bathing or bed linens.
MAKEUP REMOVER: Makeup remover is supplied for the Guest's use to remove makeup. The cleaning products provided stain the towels and wash cloths. Please use the scrub pads and/or the brown & tan towels found in the closet to clean tub/shower, sinks, floors, etc. Any stained towels or linens will be replaced using the Guest's Security Deposit. If replacement cost exceeds the Security Deposit, the Guest will be responsible for the additional cost of replacement.
BLANKETS: Guest agrees to only use the blankets in the closet for use outside.
WASHER/DRYER: Guest agrees to follow the posted instructions when operating the Washer/Dryer Combo. Washer/Dryer is for washing clothes only.
KEYS/REMOTES: Replacement costs for loss of keys is $25.00. Replacement of damaged or missing remote controllers will be deducted from the Security Deposit.
FIRE PIT: There is a fire pit located on the east side of The Cabin. If Guest requires additional firewood they can purchase a wheelbarrow full from Homeowner for $15.00. A bucket is near the fire pit for Guest to use to extinguish the fire prior to going inside for the night. Please use the horse water trough located east of the fire pit at the fence line to fill the bucket. It is the responsibility of the Guest to extinguish the fire. The fire pit IS NOT TO BE USED ON WINDY DAYS OR NIGHTS.
GRILLS: Guest is responsible for cleaning the Charcoal and Electrical BBQ Grills if used. If grills are left unclean a minimum of $50 will be deducted from Guest's Security Deposit without notice to Guest.
DISGRUNTLED GUESTS: Guest agrees to notify the Homeowner immediately if Guest is discontented in any way so Homeowner can correct the discontent upon notice and prior to Guest leaving a negative review online.
CABIN Q&A's: Guest agrees to review the "Cabin Q&As" listed on the side of the refrigerator should they have any questions prior to contacting Homeowner. Guest acknowledges that Homeowner is always available via telephone at any time, day or night if Guest desires or needs anything. Homeowner is available to assist and/or make available to Guest with anything they want or need.

DEPOSITS, DAMAGES, AND THEFT PROSECUTION

SECURITY DEPOSIT: As a part of your stay, you are required to pay a refundable $200.00 security deposit. The deposit is refundable by the seventh (7th) day after checkout date.
Should damage to The Cabin, amenities, or furnishings; missing items; or any other cost incurred by Homeowner due to Guest's stay, will be deducted from the Security Deposit. In all instances, Guest is responsible for the costs of returning the damages and/or missing items to their original state or cost of replacement. If the cost is more than the $200.00 Security Deposit, the additional cost will be invoiced to Guest and is payable upon receipt.
We understand accidents happen. If you break or damage something, please inform the Homeowner. Homeowner will use their discretion whether to deduct the breakage or damage from the security deposit. If something is broken or damaged and the Homeowner has not been informed, deduction from the security deposit will automatically be made.
THEFT: We consider theft as a crime. Any theft of any kind will be prosecuted to the fullest extent of the Law AND Homeowner will retain the total $200.00 security deposit no matter the value of the stolen item(s). We expect Guest to treat the Cabin as if it's their own. The Cabin is inspected after every Guest's departure and if the Rental Rules are not followed it could result in part or all the Security Deposit being withheld. We do not charge the usual cleaning fees. Therefore, if it takes Homeowner excessive time to clean the Cabin, deduction from the Security Deposit will be a minimum of $50.00. Basically, guest should leave the Cabin in the same condition as when they arrived. Guest can use the cleaning products and equipment found in the Cabin for cleaning the Cabin prior to Guest's departure.
INDEMNIFICATION AND LIABILITY
SAFETY: Each Guest is responsible for his or her own safety and the safety, well-being, and supervision of the other occupants of The Cabin.
SECURITY CAMERAS: The Outside of The Cabin is monitored by four motion detected Security Cameras. Homeowner will make every attempt to monitor the Security Cameras at all times during the night between the hours of 10:00 p.m. and 5:00 a.m. Upon Guest's request, Guest will be given access to the Security Cameras monitoring system.
INSURANCE: Guests expressly recognize that any insurance for The Cabin damage or loss which the Homeowner may maintain on The Cabin, does not cover the personal property of Guests, and that Guests should purchase their own insurance for Guests and their visitors if such coverage is desired. THE HOMEOWNER IS NOT RESPONSIBLE FOR ANY INJURIES OF ANY KIND, UP TO AND INCLUDING DEATH.
UNDER TEXAS LAW (CHAPTER 87, CIVIL PRACTICE AND REMEDIES CODE), A FARM ANIMAL PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN FARM ANIMAL ACTIVITIES RESULTING FROM THE INHERENT RISKS OF FARM ANIMAL ACTIVITIES.
Guest and visitors of Guest hereby waive and release any claims against, and agree to indemnify and hold harmless Homeowner, its agents, heirs, executors, administrators, legal representatives, successors, assigns, employees or representatives, officially or otherwise, against all claims of personal injury or death or property damage or loss arising from use of The Cabin and its amenities, regardless of the nature of the accident, injury or loss. Guest agrees to use The Cabin, furniture, and its amenities, entirely at the Guest's own initiative, risk, and responsibility.
SUCCESSORS: This agreement shall be binding on the agents, heirs, executors, administrators, legal representatives, successors, assigns, employees or representatives, officially or otherwise, of the respective parties. APPLICABLE LAW AND VENUE: THIS AGREEMENT, AND ALL THE RIGHTS, DUTIES AND LIABILITIES OF THE PARTIES ARISING FROM OR RELATING IN ANY WAY TO THE SUBJECT MATTER OF THIS AGREEMENT, AND THE ENTIRE RELATIONSHIP OF THE PARTIES, SHALL BE GOVERNED, INTERPRETED, CONSTRUED AND ENFORCED IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS, WITHOUT REGARD TO ITS CONFLICT OF LAW RULES, AND ANY APPLICABLE LAW. ANY PROCEEDING TO ENFORCE OR CONSTRUE THIS AGREEMENT SHALL BE BROUGHT SOLELY AND EXCLUSIVELY IN DENTON COUNTY, TEXAS, UNLESS MANDATORY VENUE LAWS OR RULES PROVIDE TO THE CONTRARY. SAVINGS CLAUSE: If any one or more of the provisions contained in the Agreement and Rental Rules shall for any reason be held to be invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provisions hereof and the Agreement shall be construed as if such invalid, illegal or unenforceable provision had never been contained herein. Guests agree to pay all reasonable costs, attorneys' fees, and expenses that shall be made or incurred by Homeowner enforcing the Agreement and Rental Rules.
